Kepemilikan Hak Cipta atas Karya AI: Studi Normatif tentang Kekosongan Hukum di Indonesia

This study aims to explore regulatory gaps in the copyright framework in Indonesia, particularly regarding works created by artificial intelligence (AI). Rapid advances in AI technology have facilitated the independent production of creative works, raising fundamental issues related to copyright ownership. The current Indonesian Copyright Law does not address AI works, resulting in legal uncertainty. This study applies a normative legal method through an examination of regulations, legal doctrine principles, and analysis of related cases. The research findings indicate a substantial legal gap in Indonesia's copyright governance, which has the potential to trigger conflicts and limit the advancement of AI innovation. This study recommends updating the Copyright Law to include specific clauses regulating the legal position of AI works, taking into account the role of human contribution in the creative process.
