Abstract

This research analyzes the digital rights paradox in the artificial intelligence era, particularly the tension between AI copyright monopolies controlled by major technology corporations and fundamental digital consumer rights. Employing normative legal research methodology through statutory, conceptual, comparative, and case study approaches, this study identifies conflict manifestations in AI-generated content ownership, closed platform ecosystems, and algorithmic opacity. The root causes include information asymmetry, economic imbalances, regulatory ambiguity, and cross-jurisdictional complexities. Conventional litigation mechanisms prove ineffective due to high costs, lengthy duration, and limited technical competence. This research explores arbitration as an alternative offering flexibility, arbiter expertise, and efficiency, yet faces fairness challenges in mandatory arbitration. Recommendations include a comprehensive arbitration framework for Indonesia that balances innovation protection and consumer rights through specialized rules, restrictions on unfair clauses, and integration with broader regulatory ecosystems.
