Analisis Yuridis Perlindungan Hukum Masyarakat Korban Mafia Tanah di Notaris

Abstract

Land is very important for human survival, but due to the increasing population and limited land availability, land has become very important for people's lives, especially in Indonesia. Legal protection can be interpreted as an effort to protect carried out by the government or authorities using the applicable legal system. Legal protection for people who are victims of the land mafia is an important issue in the context of agrarian law in Indonesia. The land mafia often involves unscrupulous officials and notaries, which have the potential to harm land rights owners. This research uses a normative juridical approach to produce conclusions from research by examining library materials or secondary data which is useful for managing and analyzing data in a summary of data presentation. Legal protection for victims of land mafia involving notaries is theoretically quite strong. However, in practice there are still many obstacles that must be overcome. Notaries must always comply with regulations, codes of ethics and morals in carrying out their duties and positions because if they are violated, what the notary does will be very detrimental to all parties if the deed they make contains legal defects due to the notary's error. Crimes against the state are considered criminal behavior from a formal legal perspective. Therefore, nothing is prohibited by this law, and anyone who violates it will be subject to sanctions in accordance with applicable law. Therefore, significant cooperation between the government and CSOs is needed so that they can become members of this land mafia.
