Abstract

The rapid development of technology, particularly Artificial Intelligence (AI), has given rise to a new paradigm in the creative industry. AI is now capable of producing a variety of artistic works, from paintings to musical compositions, that are aesthetically difficult to distinguish from human-made creations. However, the development of this technology can also lead to legal violations through acts of plagiarism. AI systems are now able to independently generate complex artistic works, raising fundamental questions about their legal status under the existing copyright law framework. This academic paper aims to analyze the position of artificial intelligence (AI) from the perspective of Indonesian law, with a focus on the Copyright Law. According to the Copyright Law, works generated by AI do not qualify as creations eligible for legal protection, because the entity recognized as a "Creator" under the Copyright Law is fundamentally a human being. This research employs a normative juridical legal research method with a statutory and conceptual approach.
