Kepemilikan dan Hak Kekayaan Intelektual atas Karya yang Dihasilkan Artificial Intelligence: Perspektif Hukum Perdata Indonesia
Keywords:

Advances in artificial intelligence (AI) pose new challenges in civil law in Indonesia, particularly in determining who owns the rights to independently produced products. Current law only recognizes individuals or institutions as legal subjects, which creates confusion when AI produces something that resembles human work. This study addresses two main questions: who should hold Intellectual Property Rights over works produced by Artificial Intelligence, according to applicable Indonesian regulations: the AI owner, the programmer, the user, or another party; and what are the challenges and weaknesses of Indonesian law related to works produced by Artificial Intelligence. The focus of this research is to explore the legal status of ownership of works produced by AI under Indonesian civil law and how it relates to developments in global law. The approach used in this research is normative juridical, through a review of regulations, comparisons, and the application of a conceptual approach. The analysis findings indicate that ownership of works produced by AI is still viewed through human relations, whether as creators, developers, or owners of the technology. However, there is an urgent need to revise the law to better align with developments in digital technology and provide legal certainty. Currently, the only possible measure is the sanctions stipulated in "Law Number 28 of 2014 concerning Copyright.
