Optimalisasi Hak Kekayaan Intelektual dalam Industri Kreatif Lokal sebagai Pendukung Ekonomi Berkelanjutan

Abstract

This study aims to analyze the legal protection of Intellectual Property Rights (IPR) in the local creative industry as a support for sustainable economy in Indonesia. This research employs a normative juridical method with a conceptual approach, supported by secondary data including laws and regulations, legal literature, and related publications. The findings indicate that although Indonesia has established a comprehensive IPR legal framework through Law No. 28 of 2014 on Copyright, Law No. 13 of 2016 on Patents, and Law No. 20 of 2016 on Trademarks and Geographical Indications, its implementation still faces various obstacles. The main barriers include low awareness among business actors, regulatory complexity, weak law enforcement, and minimal institutional support. This research finds that effective IPR protection can increase economic added value, encourage innovation, and strengthen the competitiveness of local creative industry products. The recommended optimization strategies include legal education and assistance for creative actors, simplification of digital-based IPR registration systems, strengthening law enforcement capacity, establishment of IPR asset valuation institutions, and national campaigns to cultivate a culture of respecting creative works. With the implementation of these strategies, IPR protection is expected to function optimally as an economic instrument that supports sustainability and welfare of creative industry actors in Indonesia.
