Penerapan Asas Contrarius Actus dalam Pembatalan Sertifikat Hak atas Tanah yang Diterbitkan secara Melawan Hukum

Land title certificates issued against the law are a wrongdoing that has developed in the land management system in Indonesia. This research aims to analyze the application of the principle of contrarius actus as a legal basis for canceling land title certificates issued unlawfully by state administration officials. The focus is to analyze the consistency and effectiveness of this principle in judicial practice, especially in ensuring that the authority to cancel as an action contrary to publication is only possessed by the authority previously authorized to issue. The method used is normative research with a juridical-normative approach, which involves document research and qualitative analysis of legislation and court decisions. The research results show that the principle of contrarius actus is a fundamental principle in administrative law, providing legitimacy and legal certainty in cancellation procedures. Its application limits the subjects who have the right to annul and significantly influences the PTUN court's decision. However, several challenges were found related to harmonization of regulations and official discretion. It is concluded that strengthening the application of this principle is essential to restore the legitimacy of land administration and protect community rights from administrative actions that are legally flawed.
