Peran Kecerdasan Buatan dalam Penyelesaian Sengketa Hak Kekayaan Intelektual Lintas Negara melalui Mekanisme Online Dispute Resolution ASEAN

Abstract

In the digital age and global economy, cross-border intellectual property (IP) disputes are becoming increasingly complex and frequent. Alternative Dispute Resolution (ADR) mechanisms, particularly online dispute resolution (ODR), are one solution to overcoming barriers of time, cost, and jurisdiction. This article analyzes the potential and challenges of utilizing artificial intelligence (AI) in supporting the resolution of cross-border IPR disputes through ODR within the ASEAN framework. The study covers aspects of regulation, technology, institutional readiness, ethics, and legal harmonization among ASEAN countries. The research method is normative-juridical with literature study, policy analysis, and review of regional practices and ongoing initiatives. The results show that AI has great potential to accelerate the process, improve access, and reduce costs, but challenges such as differences in legal systems, AI and data regulatory frameworks, privacy protection, and transparency need to be addressed. This article offers policy recommendations for ASEAN to develop an effective and fair AI-enabled ODR framework.
