Implikasi Pasal 1 Ayat (3) Undang-Undang Hak Cipta terhadap HKI Ciptaan AI: Pendekatan Yuridis Normatif untuk Respons Strategis Perdata Nasional Indonesia Menghadapi Tantangan Disrupsi Kreatif

The development of artificial intelligence (AI) has created new creative works that have created a normative vacuum in Article 1 paragraph (3) of the Indonesian Copyright Law, which explicitly recognizes humans as creators. This vacuum has opened up legal gaps regarding the protection and ownership status of AI-generated works. This study uses a normative juridical approach to analyze this problem using extensive interpretation methods, legal analogies, and new legal constructions to fill the legal vacuum. The results of the study formulate a response strategy framework through regulatory revisions that accommodate the involvement of AI technology by emphasizing the contribution of creative humans, as well as the development of adaptive judicial and administrative guidelines. This approach is expected to provide legal certainty, encourage technological innovation, and support the development of the digital creative industry in Indonesia.
